NOTICE OF BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER

2. Billow Services

Billow provides services to help individuals understand, identify errors in, and reduce their medical bills. The Service includes:

  • Uploading and analyzing medical bills.

  • Providing AI-powered Blip Reports to identify billing discrepancies.

  • Offering tools to dispute charges and advocate for accurate billing.

By using the Service, you authorize Billow to act as your agent when interacting with third parties, such as healthcare providers, to fulfill these services.

3. Your Account

To use the Service, you may need to create an account ("Account") by providing accurate and complete information, including your name, email address, and other relevant details.

Your Responsibilities:

  • You are solely responsible for maintaining the confidentiality of your Account credentials.

  • You agree to notify us immediately if you suspect unauthorized access or use of your Account.

  • You agree not to share your Account credentials with others.

Our Rights:
We reserve the right to suspend or terminate your Account at any time, for any reason, including violation of these Terms or as required by law.

8. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, BILLING SHALL NOT BE LIABLE FOR:

  • INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

  • DAMAGES EXCEEDING THE FEES PAID BY YOU IN THE PRIOR 12 MONTHS.

9. Dispute Resolution and Class Action Waiver

If you have a dispute with Billow, you agree to first notify us at help@billowcares.com and attempt to resolve it informally.

Arbitration:
If the dispute cannot be resolved informally within 60 days, it shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). Arbitration will occur on an individual basis, and class actions or representative proceedings are prohibited.

10. Indemnification

You agree to indemnify, defend, and hold harmless Billow from any claims, damages, or expenses arising from:

  • Your breach of these Terms.

  • Your use of the Service.

  • Your violation of any applicable law.

11. Governing Law

These Terms are governed by the laws of South Carolina, without regard to conflict of laws principles.

12. Amendments

We may update these Terms at any time. Changes will be posted on this page with an updated "Effective Date." Continued use of the Service constitutes acceptance of the revised Terms.
